These Terms and Conditions govern participation in the BITE Partner Program and form a binding agreement between BITE, also referred to as “BITE,” “we,” “our,” or “us,” and any individual, business, influencer, organization, or other party applying for or participating in the program, referred to as “Partner,” “you,” or “your.”
By applying for, enrolling in, or participating in the BITE Partner Program, you agree to be bound by these Terms and Conditions.
The BITE Partner Program allows approved partners to promote BITE General Admission Tickets and earn commissions on qualifying ticket sales that are properly tracked through an approved referral method designated by BITE.
At the time of this agreement, the ticket offered through the program is the BITE General Admission Ticket, which is priced at $65.00 per ticket.
Approved partners are eligible to earn a 50% commission, which equals $32.50 per qualifying ticket sale, subject to the terms of this agreement.
Participation in the BITE Partner Program is by approval only. Submission of an application does not guarantee acceptance into the program.
BITE reserves the right to approve or deny any application for any lawful reason and in its sole discretion.
You agree to provide accurate, current, and complete information during the application process and throughout your participation in the program.
If any information you provide is false, misleading, incomplete, or outdated, BITE may reject your application, suspend your account, withhold commissions, or terminate your participation.
Partners approved into the BITE Partner Program may earn a 50% commission on each qualifying sale of a BITE General Admission Ticket sold at the current program price of $65.00.
A qualifying sale means a completed ticket purchase that:
is properly attributed to your approved referral link or tracking method,
is successfully paid,
is not canceled, refunded, reversed, disputed, or charged back, and
is not generated through fraud, self-dealing, prohibited methods, or violation of these Terms and Conditions.
BITE reserves the right to determine, in its sole discretion, whether a sale qualifies for commission.
Commissions will only be paid on sales that are properly tracked through BITE’s approved systems, links, codes, or other designated attribution methods.
BITE is not responsible for commissions lost due to technical issues, broken links, deleted cookies, incorrect tracking setup, customer behavior outside the tracking window, platform outages, or unauthorized use of links.
If a sale cannot be verified or properly attributed to your account, BITE is not obligated to pay a commission on that sale.
Approved commissions will be paid according to BITE’s payout schedule, which may be established, updated, or communicated separately by BITE.
BITE may delay payout for a reasonable verification period to confirm the validity of ticket sales, refund status, chargeback risk, and compliance with these Terms and Conditions.
BITE may withhold, offset, reverse, or cancel commissions in whole or in part if:
a sale is refunded, canceled, disputed, or charged back,
a commission was credited in error,
fraudulent or suspicious activity is detected,
these Terms and Conditions are violated, or
required tax or payment information has not been provided.
You are solely responsible for providing accurate payment details and any tax information required by law.
As a condition of participation, you agree to promote BITE in a lawful, honest, professional, and ethical manner.
You agree that you will not:
make false, misleading, deceptive, or exaggerated statements about BITE, its events, its tickets, or its offerings,
misrepresent yourself as an employee, agent, owner, or legal representative of BITE,
use spam, unsolicited messages, or unlawful marketing tactics,
use bots, fake accounts, fake purchases, fraudulent traffic, or misleading ad practices,
engage in self-referrals or purchase tickets through your own referral link for the purpose of generating commission unless expressly authorized in writing by BITE,
use trademarked terms, domain names, social usernames, or branding that falsely imply official affiliation with BITE,
run paid ads using BITE’s brand name in a misleading way,
post promotional content in a way that violates platform rules or applicable law,
offer unauthorized rebates, discounts, incentives, or side deals without written approval from BITE.
You are responsible for ensuring that all content, posts, emails, promotions, and outreach related to the BITE Partner Program comply with all applicable laws, platform rules, and advertising disclosure requirements.
BITE takes fraud prevention and program integrity seriously.
BITE reserves the right to terminate, suspend, or restrict your participation in the BITE Partner Program at any time, without warning, if fraudulent activity is suspected.
Fraudulent or suspicious activity may include, but is not limited to:
fake purchases,
self-dealing,
use of stolen payment methods,
chargeback abuse,
fake accounts,
bot traffic,
manipulated clicks or conversions,
false advertising,
impersonation,
misleading claims,
unauthorized use of branded assets,
any conduct that BITE believes harms the integrity of the program.
If BITE suspects fraud or abuse, BITE may, in its sole discretion:
terminate your account immediately,
suspend your tracking access,
withhold unpaid commissions,
reverse previously credited commissions,
deny future participation,
investigate related activity,
report conduct to payment processors, platforms, or legal authorities where appropriate.
BITE is not required to provide advance notice before taking action in cases of suspected fraud.
This agreement begins when you are accepted into the BITE Partner Program and continues until terminated by either party.
You may terminate your participation at any time by providing written notice to BITE.
BITE may suspend or terminate your participation at any time, with or without cause, and with or without prior notice, in its sole discretion.
Upon termination:
your right to promote the BITE Partner Program immediately ends,
you must stop using BITE’s promotional materials, branding, and referral links,
unpaid commissions may be forfeited if they relate to violations, fraud, disputed activity, or noncompliance,
BITE may deactivate your account and tracking access.
BITE may provide approved logos, graphics, marketing language, event descriptions, and other promotional materials for your use in connection with the program.
BITE grants you a limited, revocable, non-exclusive, non-transferable right to use approved promotional materials solely for the purpose of promoting the BITE Partner Program during your active participation.
You may not modify, misuse, distort, or use BITE’s name, logo, trademarks, branding, event materials, or intellectual property in any way that is misleading, offensive, unlawful, or not expressly authorized.
All rights, title, and interest in BITE’s intellectual property remain solely with BITE.
Your participation in the BITE Partner Program does not create any employment, agency, partnership, joint venture, franchise, fiduciary, or representative relationship between you and BITE.
You are an independent participant and have no authority to bind BITE to any contract, obligation, representation, or commitment.
You are solely responsible for any federal, state, or local taxes arising from commissions or other payments you receive under the BITE Partner Program.
If BITE is legally required to collect tax forms, issue tax documents, or withhold amounts, you agree to provide the necessary information.
The BITE Partner Program is provided on an “as is” and “as available” basis.
BITE makes no guarantees regarding acceptance into the program, continued participation, sales volume, conversion rates, earnings, availability of the program, tracking accuracy, or any specific financial result.
To the fullest extent permitted by law, BITE disclaims all warranties, express or implied, including any implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
To the fullest extent permitted by law, BITE shall not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, including lost profits, lost data, lost business opportunities, or reputational harm, arising out of or related to the BITE Partner Program.
BITE’s total liability under these Terms and Conditions shall not exceed the total amount of commissions actually paid to you by BITE during the three-month period immediately preceding the event giving rise to the claim.
You agree to defend, indemnify, and hold harmless BITE, its owners, officers, employees, contractors, affiliates, successors, and assigns from and against any claims, damages, liabilities, losses, costs, and expenses, including reasonable attorneys’ fees, arising out of or related to:
your participation in the program,
your marketing content or promotional conduct,
your violation of these Terms and Conditions,
your violation of any law, rule, platform policy, or third-party right.
You agree to comply with all applicable laws, regulations, advertising disclosure requirements, privacy requirements, email and text messaging laws, consumer protection laws, and platform rules in connection with your participation in the BITE Partner Program.
This includes making any legally required disclosures that you may earn a commission from promoted ticket sales.
BITE reserves the right to update, modify, suspend, or discontinue the BITE Partner Program, its commission structure, eligible products, ticket pricing, promotional rules, payout procedures, or these Terms and Conditions at any time.
Any updates become effective when posted or otherwise communicated by BITE, unless a later effective date is stated.
Your continued participation after any update means you accept the revised Terms and Conditions.
Any non-public information shared with you regarding BITE’s business, payout processes, strategies, marketing plans, customer information, or internal operations shall be treated as confidential and may not be disclosed or used for any purpose other than participation in the BITE Partner Program, unless authorized in writing or required by law.
These Terms and Conditions shall be governed by and interpreted in accordance with the laws of the State of [Insert State], without regard to conflict of law principles.
Any dispute arising out of or relating to the BITE Partner Program or these Terms and Conditions shall be brought exclusively in the state or federal courts located in Virginia, and you consent to the jurisdiction and venue of those courts.
If any provision of these Terms and Conditions is held to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.
These Terms and Conditions, together with any incorporated policies, guidelines, payout terms, or related program documents issued by BITE, constitute the entire agreement between you and BITE regarding the BITE Partner Program and supersede all prior discussions or understandings relating to the program.
